Terms of Service

By accessing or using the XelNav Closed Beta platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not access or use the platform. These terms apply to all beta participants, developers, and any individual accessing XelNav services during the Closed Beta phase.

Access to XelNav during the Closed Beta is by invitation only. XelNav reserves the right to:

• Revoke beta access at any time without prior notice.
• Modify, suspend, or discontinue any part of the platform at any time.
• Limit the number of participants, API calls, or features available during the beta period.

Beta access is granted for evaluation and testing purposes only. It does not constitute a commercial license.

XelNav and its licensors retain all right, title, and interest in and to the platform, including all associated intellectual property rights. You are granted a limited, non-exclusive, non-transferable license to use the platform solely for evaluation during the Closed Beta. You may not copy, modify, distribute, sell, or lease any part of the platform or its underlying technology.

The XelNav Closed Beta is confidential. You agree not to disclose, publish, or share details of the platform — including features, performance benchmarks, screenshots, or pricing — without prior written consent from XelNav. This obligation survives termination of your beta access.

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable regulations.
• Attempt to probe, scan, or test the vulnerability of XelNav systems or networks.
• Reverse engineer, decompile, or disassemble any component of the platform.
• Use the platform to build a competing product or service.
• Transmit any malicious code, virus, or disruptive data through the platform.

The XelNav platform is provided "as is" and "as available" during the Closed Beta. XelNav makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the platform will be uninterrupted, error-free, or free of harmful components during the beta period.

To the maximum extent permitted by law, XelNav shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform during the Closed Beta, including but not limited to loss of data, revenue, or profits.

These Terms of Service shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of the XelNav platform shall be resolved through binding arbitration, except where prohibited by law.

XelNav reserves the right to update or modify these Terms of Service at any time. We will notify Closed Beta participants of material changes via the email address associated with their beta account. Continued use of the platform after such notice constitutes acceptance of the revised terms.
